Can NSWPA represent me?
Because NSWPA is not a union, under workplace laws it has very limited ability to represent workers.
NSWPA cannot perform many of the basic representation functions of a union.
NSWPA cannot bring proceedings against your employer for a breach of your employment conditions as an applicant, and cannot get a permit to enter your workplace to support you and other members.
Additionally, NSWPA cannot represent you for:
- Formal unfair dismissal or bullying proceedings or applications
- Federal Court small claims proceedings as an automatic right
Finally, NSWPA cannot be covered by an Enterprise Agreement.
